1. Introduction and Acceptance

Welcome to Photo Video AI (pvid.app), an AI-powered photo to video generation platform. By accessing or using our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, please do not use our services.

2. Description of Service

Photo Video AI provides an AI-powered platform for converting photos to videos and generating AI video content. Our services include but are not limited to:

Photo to video conversion using advanced AI models
Text-to-video generation from text prompts
Video-to-video transformation with motion control
Multiple aspect ratio and resolution options (up to 4K)
AI motion control, camera style, and cinematic effects
Credit-based usage system with subscription plans

3. Account Registration

Eligibility: You must be at least 13 years old to use Photo Video AI. If you are under 18, you must have parental or guardian consent.
Account Creation: You must provide accurate and complete information when creating an account. You may register using email or third-party authentication (Google).
Account Security: You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. Notify us immediately of any unauthorized access.

4. Credits, Pricing, and Payments

Credit System: Video generation consumes credits based on the mode (text-to-video, image-to-video, video-to-video), duration, and resolution selected.
Subscriptions: We offer monthly and annual subscription plans with varying credit allocations and daily generation limits. Plan details and pricing are available on our Pricing page.
Credit Packs: One-time credit purchases are available for users who prefer pay-as-you-go.
Billing: Payments are processed through secure third-party payment providers. By purchasing a plan or credits, you authorize recurring charges as applicable.
Refund Policy: All purchases are final and non-refundable, except where required by applicable law. Unused credits do not carry over after subscription cancellation unless otherwise stated.

5. Acceptable Use

You agree not to:

Generate videos that contain illegal content, including but not limited to child sexual abuse material (CSAM), non-consensual intimate imagery, or content that violates applicable laws
Use the service to create deceptive deepfakes or misleading content intended to cause harm
Attempt to reverse-engineer, extract, or replicate the underlying AI models
Circumvent usage limits, credit systems, or security measures
Use automated tools (bots, scrapers) to access the service without authorization
Resell, redistribute, or sublicense access to Photo Video AI without written permission
Upload content that infringes third-party intellectual property rights

We reserve the right to suspend or terminate accounts that violate these terms.

6. Intellectual Property

Platform: The Photo Video AI platform, including its design, code, branding, and documentation, is owned by Photo Video AI and protected by intellectual property laws.
Generated Content: Videos you generate using Photo Video AI are yours to use, subject to the following:
- You are responsible for ensuring your use of generated videos complies with applicable laws
- Photo Video AI does not claim ownership of your generated videos
- We may retain generated videos temporarily for service delivery and debugging purposes
User Content: You retain ownership of any prompts, photos, reference videos, or other content you submit. By submitting content, you grant Photo Video AI a limited license to process it for the purpose of providing the service.

7. AI Model Disclaimer

Photo Video AI integrates multiple third-party AI models for video generation. Output quality may vary across models.
AI-generated videos may occasionally contain artifacts, inaccuracies, or unintended content. We do not guarantee that all outputs will meet your expectations.
We continuously work to improve output quality but make no warranties regarding specific results.

8. Privacy

Your use of Photo Video AI is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
We reserve the right to modify, suspend, or discontinue any feature of the service at any time, with or without notice.

10. Disclaimer of Warranties

The service is provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, Photo Video AI disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the fullest extent permitted by law, Photo Video AI and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the service.

Our total liability for any claim arising from or related to the service shall not exceed the amount you paid to Photo Video AI in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Photo Video AI, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

Your use of the service
Your violation of these Terms
Your violation of any third-party rights
Content you generate or submit through the service

13. Termination

You may delete your account at any time.
We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion.
Upon termination, your right to use the service ceases immediately. Unused credits are forfeited unless otherwise required by law.
